Awaiting legal review
This page describes how the service actually works, but a qualified lawyer has not yet reviewed the wording. It will be updated once that review is done.
These terms apply to everyone who uses OMG! Translate!, customers and translators alike. By creating an account or using the service, you agree to these terms and to our Privacy Policy, Refund Policy and Disclaimer, which all form part of this agreement. If you do not agree, do not use the service. The service is provided by:

1. The service
OMG! Translate! connects customers with independent human interpreters for real-time voice calls, made in a web browser or in our mobile app. There are no dial-in telephone numbers. We provide the platform; interpreters provide the interpreting.
2. Accounts
You must give accurate registration details, keep your credentials secure, and are responsible for activity under your account. We may suspend or close an account that breaches these terms or presents a risk to the service. An account that still holds credit is not closed until that credit has been refunded or paid out.
3. Charges
Calls are priced per minute at the price shown to you before the call starts. Prices include IVA. The price is fixed when you confirm the call and does not change during it, even if our prices change later. Charges are taken from your prepaid credit.
Calls are charged in advance, in blocks of 30 seconds. Each block costs half the price per minute, rounded to the nearest cent (a half cent is rounded up). The first block is charged when the call connects, and each further block as it begins. Waiting for a translator and ringing are never charged, and no block is charged once a call has ended, including a call that ended because the connection was lost.
A block that has begun is charged in full, even if the call ends before the block is over, because the translator is paid for the whole block. If your credit cannot pay for the next block, we tell you, and you have 30 seconds to add credit; if you do not, the call ends. You can add credit at any time during a call.
If nobody can take your call within five minutes, we stop looking and tell you. Nothing is charged.
Call charges are not refundable. The only refund we give is for credit you have not spent, as set out in the Refund Policy.
4. Translators
Translators are independent professionals, not our employees. We pay translators for the calls they take. Their earnings are added to their balance and can be withdrawn with a payout request, subject to the minimum payout amount.
5. Recording
We do not record calls and do not make transcripts. We will not begin doing either without first changing these terms. You may not record a call yourself without the consent of everyone on it.
6. Acceptable use
You may not use the service unlawfully, harass or abuse anyone on a call, share another person’s account, or attempt to get around billing. Either side of a call can report the other, and can block them from being matched again.
7. Our responsibility
You use the service at your own risk. We are not responsible for any consequences arising from the use or misuse of the service, including anything said, understood, agreed or decided during or after a call. The Disclaimer explains what interpreting should and should not be relied on for.
Calls run over the internet. We are not responsible for dropped calls, poor audio or any other problem caused by anything outside our own infrastructure, including your device, your internet or mobile connection, the other person’s connection, and the networks and third-party services in between. Charges for those calls are not refunded.
Nothing in these terms limits any liability that the law does not allow to be limited.
8. Governing law and disputes
These terms are governed by Spanish law. If you are a consumer, you may bring proceedings in the courts of the place where you live, and you keep the protection of the mandatory consumer laws of the country you live in.
9. Changes
We update these terms, the Privacy Policy, the Refund Policy and the Disclaimer from time to time. The date at the top of each shows when it last changed, and it is your responsibility to check them. If you keep using the service after a change, you accept it. If you do not agree, stop using the service. You can close your account and ask for any unspent credit to be refunded.
